A determination not to compete this proposed contract was made pursuant to Federal Acquisition Regulation (FAR) 8.405-6(c) and 13.106-1(b)(1)(i). Sciton Inc. is the only known source that can provide the required Erd:YAG Hybrid Fractional Laser delivery of both ablative and non-ablative wavelengths to the same or different microscopic treatment areas of patients. The Government contemplates the award of a Firm-Fixed-Price commercial supply contract.

This procurement is being conducted under FAR Part 8. Only one source is reasonably available based on their possession of patents for this hybrid technology. The North American Industry Classification System (NAICS) code for this procurement is 339112. The Small Business Size Standard is 1,000 employees.

Parts to be acquired from a single source that are not currently on FSS contract schedule:

1. Single 1470 nm Module High Powered Diode Laser – Arm delivered;


2. Hero module accessory; and


3. Halo™ Module II (200µ – 700µ) 1470 hd required, incl. 20 Vortex™ Adapters and 1 for installation.

This notice of intent is not a request for competitive proposals and no solicitation document will be released. Interested parties must submit a capability statement that provides clear and convincing management, technical data, and cost information that the interested party can provide the requirement. Capability statements shall not exceed 6 (8.5 x 11 inch) pages or use less than 11 point font. A determination not to compete based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement or to proceed with a limited-sources purchase order.
